Terms & Conditions.

These terms govern the coaching services provided by Simon Personal Trainer. By submitting an application, booking a session or entering into a coaching agreement, you agree to the terms set out below.

Services

Simon Personal Trainer provides in-person and hybrid coaching from Treehouse Hotel Manchester, online coaching delivered worldwide, postural analysis, and sports massage therapy. All services are delivered by Simon Matejczuk, a Level 4 Personal Trainer, CPS Certified Posture Specialist, Level 3 Sports Massage Therapist, GP Referral qualified coach and CIMSPA-registered professional.

Applications and bookings

Coaching engagements begin when you submit an application, which is reviewed personally. We may decline an application where the fit is not right for either party. Where an application is accepted, a written coaching agreement will be issued setting out the specific scope, duration, deliverables and fees applicable to your programme.

Fees and payment

Fees are quoted on an individual basis following your initial consultation and are set out in your coaching agreement. Payment terms, billing cycles and any deposit requirements are specified there. Invoices are payable on the dates stated in the agreement. Failure to pay an invoice may result in services being paused until the account is brought up to date.

Cancellations and missed sessions

In-person sessions may be rescheduled with at least twenty-four hours' notice. Sessions cancelled or missed inside that window remain payable. Specific cancellation arrangements for ongoing programmes are set out in your coaching agreement.

Health and safety

Before training begins you will be asked to complete a health screening questionnaire. You are responsible for disclosing relevant medical conditions, injuries, medications and any advice from your GP or specialist. Where appropriate, you may be asked to obtain medical clearance before starting a programme. You agree to stop any exercise that causes pain or undue distress and to communicate openly with your coach about how you are responding to training.

Physical training carries inherent risks. Every reasonable effort is made to mitigate those risks through assessment, programme design and supervision, but the client accepts those inherent risks when participating.

Results

Coaching results depend on consistency, individual physiology, adherence and many factors outside the coach's control. No specific outcome is guaranteed. Testimonials and transformations displayed on this site reflect individual results and are not promises of comparable outcomes.

Intellectual property

Training programmes, content, methodology documents and the materials you receive as part of coaching are provided for your personal use only. They may not be copied, shared, resold or used to deliver services to third parties without written permission.

Confidentiality

Information you share during coaching is treated as confidential and is only used to support your programme, as described in our Privacy Policy.

Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under English law. Subject to that, liability for any claim relating to the services is limited to the fees paid for the period in which the issue arose.

Termination

Either party may end a coaching engagement in accordance with the notice provisions in the coaching agreement. Outstanding fees for services already delivered remain payable.

Governing law

These terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
